小额诉讼程序在司法实践中存在的问题及建议

【摘 要】小额诉讼程序的设立是我国对审判资源合理配置的积极探索、是践行司法为民理念的先进成果。通过现实中的司法实践探索，小额诉讼程序尚处于试水阶段，有许多不足之处，如案件适用范围需要进一步明确、权利救济渠道需要更通畅、诉前调解与小额诉讼程序中的调解重合等问题，都要求在实践中逐步完善。%The establishment of small litigation procedure is a positive exploration of the rational allocation of judicial resources in our country, and it is the

advanced achievements of practicing the concept of justice for the people. By exploring the reality of judicial practice, small claims procedure is still in the testing phase, many deficiencies, such as needs the applicable scope of the case further clear, the right relief channel requires more unobstructed, pre litigation mediation and small claims procedure in the mediation of the overlapping problem, requirements and the gradual improvement in practice.
